18 U.S.C. 2257 Exemption Statement

WhatsThatPorn is a search index. It produces no content. All visual depictions accessible from this site are hosted by, and were produced by, the third-party studios that own them. We create no imagery, we host no video, and we upload nothing.

Why this site is exempt

The content displayed here consists of thumbnails, promotional previews and metadata supplied by the producers or their distribution partners, embedded or linked from their own servers. With respect to that material, the operator of WhatsThatPorn is neither a primary nor a secondary producer as those terms are defined in 28 C.F.R. 75.

Accordingly, WhatsThatPorn qualifies for the exemption at 18 U.S.C. 2257(h)(2)(B)(v) and 28 C.F.R. 75.7, and holds no records subject to those provisions.

Where the records are held

Records required by 18 U.S.C. 2257 and 2257A for any depiction reachable from this site are maintained by the originating studio. Each scene page names its studio and links to it. The custodian of records for a given depiction is identified in the 2257 statement published on that studio’s own website.

Age of performers

We index only material from commercial studios that represent all performers were at least 18 years of age at the time of production. Any content believed to depict a minor is removed on notice and reported to the National Center for Missing and Exploited Children.
